Part 2 -   Addressing Life Care Issues and the Importance of Advanced Directives

Come join us and learn about this important subject in part three of New York City based estate planning and elder law attorney Lorese Phillips’ series on “Planning for Your Future: Addressing Life Care Issues and the Importance of Advanced Directives”.

Ms. Phillips will discuss advanced care planning for persons of every age and stage of life through the use of relatively simple legal documents known as advanced directives.


In her presentation, Attorney Phillips will address:
  • What advanced directives are;
  • Why they are highly recommended;
  • Advanced directives that elder law attorneys recommend (but are not just for the elderly!) – specifically;
    • Health Care Proxy or Health Care Directive;
    • HIPAA Release; a Living Will for End-of-Life Care,
    • Durable Power of Attorney;
    • Appointment of an Agent for the Disposition of Remains;
  • What to consider when selecting Agents to advocate your wishes and options for solo agers;
  • Specific instructions to include to direct your Agents and give them broad authority, if ever needed;
  • Who the law may authorize to act if you do not appoint someone, and when guardianship may be the only alternative;
  • Hospital and Non-Hospital Do Not Resuscitate Orders;
  • Medical Orders for Life Sustaining Treatment (the “MOLST” form); 
  • The new "New York Medical Aid in Dying Act".

Part 4 - What is Elder Law and When Do You Need an Elder Law Attorney?


Lorese Phillips

Lorese Phillips is an attorney in private practice in New York City with over twenty-nine years of experience in all aspects of trusts and estates, Elder Law, representing persons with disabilities and residential real estate transactions. Her practice includes preparing Last Wills, trusts, and advanced directives, and counseling clients on estate planning, tax planning, long-term care, asset protection planning, and eligibility for government benefits. Ms. Phillips also represents clients in probate proceedings, trust and estate administration matters, and residential real estate transfers.

Ms. Phillips has been annually recognized by Best Lawyers in America in Elder Law since 2022, and her firm has been ranked as a Tier 1 Best Law Firm in Elder Law by Best Lawyers in America. She has also been selected to Super Lawyers since 2023. She is an active member of the New York State Bar Association, where she currently serves on the Executive Committee of the Elder Law and Special Needs Section and Co-Chairs its Estates, Trusts, and Tax Issues Committee. In addition, she is an active member of the NYSBA Trusts & Estates Law and Real Property Law Sections. Ms. Phillips has been a long-time member of the New York City Bar Association and a current member of the National Academy of Elder Law Attorneys (NAELA). 

Ms. Phillips also serves on the Board of Directors of a not-for-profit organization that addresses the needs of seniors in and around New York County.

Ms. Phillips has lectured before the New York State Bar and the New York City Bar Associations, the Practicing Law Institute, the Dickinson School of Law at Penn State University, as well as to local New York City senior groups. She has a B.A. from SUNY Stony Brook (Phi Beta Kappa), an M.F.A. from Columbia University School of the Arts (Sculpture), and a J.D. from the Benjamin N. Cardozo School of Law.
